This Acceptable Use Policy outlines prohibited activities and behaviors on the DeckzMart platform. By using our services, you agree to comply with this policy.
1. Overview
DeckzMart is committed to providing a safe, professional, and reliable platform for property professionals and clients. This policy protects all users and ensures the platform is used ethically and legally.
2. Prohibited Activities
2.1 Illegal Activities
You must NOT use DeckzMart to:
- Violate any UK or international laws or regulations
- Engage in money laundering or terrorist financing
- Facilitate fraud or deceptive practices
- Infringe on intellectual property rights
- Distribute illegal content or materials
- Violate data protection laws (GDPR, DPA 2018)
- Engage in discriminatory practices prohibited by the Equality Act 2010
2.2 Fraudulent Property Listings
Property listings must be:
- Genuine: Only list properties you are authorized to market
- Accurate: Provide truthful descriptions, prices, and availability
- Current: Keep information up to date
- Complete: Disclose material facts and defects
Prohibited:
- Listing properties you don't have authority to market
- Misleading descriptions or photographs
- False pricing or "bait and switch" tactics
- Concealing defects or problems
- Duplicate listings of the same property
2.3 Harassment and Abuse
You must NOT:
- Harass, threaten, or intimidate other users
- Use discriminatory, hateful, or offensive language
- Engage in cyberbullying or stalking
- Make unwanted contact after being asked to stop
- Impersonate others or create fake accounts
- Share private information without consent (doxxing)
2.4 Spam and Unsolicited Communications
Do NOT:
- Send unsolicited bulk messages or emails
- Use the platform for phishing or social engineering
- Post repetitive or irrelevant content
- Advertise unrelated products or services
- Create multiple accounts to circumvent restrictions
2.5 Data Scraping and Harvesting
You must NOT:
- Use automated tools (bots, scrapers) to extract data
- Harvest user information for marketing or other purposes
- Access data you're not authorized to view
- Redistribute or resell platform data
- Circumvent rate limits or access controls
2.6 Unauthorized Access and Security Violations
Do NOT attempt to:
- Access accounts, data, or systems without authorization
- Bypass authentication or security measures
- Exploit vulnerabilities or security flaws
- Introduce malware, viruses, or malicious code
- Conduct penetration testing without written permission
- Use stolen credentials or share account access
2.7 Platform Reselling
Without written authorization, you must NOT:
- Resell access to the DeckzMart platform
- Sublicense your account to third parties
- Create white-label versions of the platform
- Charge others for platform access
2.8 Reverse Engineering
You must NOT:
- Decompile, disassemble, or reverse engineer our software
- Extract source code or proprietary algorithms
- Create derivative works or competing services
- Circumvent licensing or usage restrictions
2.9 System Abuse and Resource Overuse
Do NOT:
- Overload servers or networks
- Launch denial-of-service (DoS) attacks
- Make excessive API requests
- Use the platform for cryptocurrency mining
- Consume unreasonable resources that impact other users
2.10 Intellectual Property Violations
You must NOT:
- Use copyrighted images or content without permission
- Infringe on trademarks or trade names
- Violate third-party intellectual property rights
- Remove or alter copyright notices or watermarks
2.11 Misrepresentation and Impersonation
Do NOT:
- Impersonate other users, businesses, or organizations
- Falsely claim affiliations or certifications
- Use misleading business names or profiles
- Pretend to be DeckzMart staff or representatives
2.12 Interference with Platform Operations
You must NOT:
- Disrupt platform operations or availability
- Interfere with other users' access
- Manipulate reviews, ratings, or analytics
- Attempt to bypass paywalls or usage limits
3. Professional Standards for Property Professionals
3.1 Industry Regulations
Estate agents and property professionals must:
- Comply with the Estate Agents Act 1979
- Follow Consumer Protection from Unfair Trading Regulations 2008
- Adhere to industry codes of conduct (NAEA, ARLA, etc.)
- Maintain required professional licenses and memberships
- Display required client money protection and redress scheme memberships
3.2 Data Protection for Client Data
When managing client/tenant data through DeckzMart CRM:
- Comply with UK GDPR and DPA 2018
- Process data lawfully, fairly, and transparently
- Obtain necessary consents for data processing
- Respond to data subject access requests
- Report data breaches to the ICO where required
3.3 Right to Rent Compliance
Landlords and agents must:
- Verify tenants' right to rent in the UK
- Keep appropriate documentation
- Not discriminate based on nationality or immigration status
4. Consequences of Policy Violations
4.1 Warning
For minor or first-time violations:
- Written warning via email
- Explanation of the violation
- Instruction to cease prohibited activity
- Warning remains on file for 12 months
4.2 Temporary Suspension
For serious or repeated violations:
- Account suspended for 7-30 days
- Access to platform restricted
- Must acknowledge policy before reinstatement
- May require remedial actions
4.3 Permanent Termination
For severe violations or repeated offenses:
- Account permanently closed
- All access revoked
- No refund of subscription fees
- May be banned from creating new accounts
4.4 Legal Action
For violations involving:
- Fraud or illegal activity: Report to law enforcement
- Intellectual property infringement: Report to rights holders
- Data breaches: Report to ICO
- Financial harm: Pursue civil remedies
- Security violations: Criminal prosecution under Computer Misuse Act 1990
4.5 Cooperation with Authorities
We will cooperate with:
- Law enforcement investigations
- Court orders and subpoenas
- Regulatory bodies (ICO, HMRC, etc.)
- Professional standards organizations
5. Reporting Violations
5.1 How to Report
If you encounter policy violations:
- Email: abuse@deckzmart.com
- Include:
- Your contact information
- Description of the violation
- Evidence (screenshots, URLs, etc.)
- Date and time of incident
- Response: We will investigate within 5 business days
5.2 Whistleblower Protection
If you report violations in good faith:
- Your identity will be kept confidential (where legally possible)
- No retaliation or negative consequences
- Protected under whistleblowing laws
5.3 False Reports
Malicious or false reports are prohibited and may result in:
- Account warnings or suspension
- Liability for damages
- Legal action for defamation
6. Appeals Process
6.1 How to Appeal
If you believe enforcement action was taken in error:
- Email: appeals@deckzmart.com within 14 days
- Include:
- Account details
- Explanation of why action was unjustified
- Supporting evidence
- Review: Independent review within 10 business days
- Decision: Final decision communicated with reasoning
6.2 Reinstatement
If your appeal is successful:
- Account will be reinstated
- Suspension period credited to your subscription
- Warning removed from file
7. Updates to This Policy
We may update this Acceptable Use Policy to:
- Address new types of abuse
- Comply with legal changes
- Improve clarity
Updates will be posted with a revised "Last Updated" date. Material changes will be communicated via email.
