• Market Analytics Platform: Real-time market insights, trends analysis, and predictive analytics
• Property Listing Services: Professional property listing creation and management
• Communications Tools: Integrated messaging, email, and notification systems
• Third-Party Service Integration: Partnerships with service providers including Alan Boswell Group and HomeLet
• AI-Powered Features: Machine learning-based recommendations and workflow automation (current and future features)

3. User Accounts and Registration

3.1 Account Types

DeckzMart offers multiple account types:

• Estate Agents: Full platform access for property professionals
• Property Managers/Landlords: Portfolio management and tenant relationship tools
• Property Owners: Limited access for property listing and management
• Clients/Tenants: Public access for property search and inquiry submission

3.2 Registration Requirements

To register for an account, you must:

• Be at least 18 years old
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept full responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. We recommend using strong, unique passwords and enabling two-factor authentication when available. You agree to notify us immediately of any unauthorized use of your account.

3.4 Multi-User Access

Business accounts may grant access to multiple team members. The account owner is responsible for all activities conducted by authorized users and must ensure all users comply with these Terms.

4. Subscription and Pricing

4.1 Service Tiers

DeckzMart operates on a freemium model with the following structures:

• Free Tier: Limited access to core features
• Professional Tier: Monthly or annual subscription with full feature access
• Enterprise Tier: Custom pricing for large organizations

4.2 Pricing and Payment

Pricing details are available on our website and may include:

• Monthly subscription fees
• Annual subscription fees (with discount)
• Per-property or per-listing charges (where applicable)
• Usage-based fees for certain premium features

Note: Payment processing is currently being implemented. All pricing and payment terms will be clearly communicated before any charges are applied.

4.3 Price Changes

We reserve the right to modify our pricing structure. Existing subscribers will be notified at least 30 days before any price changes take effect. Continued use of the service after notification constitutes acceptance of the new pricing.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. Refunds are handled on a case-by-case basis and may be provided for:

• Service outages lasting more than 48 hours
• Billing errors
• Cancellation within 14 days of initial subscription (UK Consumer Rights)

5. Data Ownership and Usage Rights

5.1 Your Data

You retain all ownership rights to the data you input into the DeckzMart platform, including:

• Property listings and descriptions
• Client and tenant information
• Communications and interactions
• Files, documents, and images

5.2 License to Use Your Data

By using our services, you grant DeckzMart a limited, non-exclusive, royalty-free license to:

• Store and process your data to provide the service
• Display property listings on our platform
• Use aggregated, anonymized data for analytics and service improvement
• Create backup copies for disaster recovery

5.3 Data Portability

You have the right to export your data at any time in standard formats (CSV, JSON). Upon account deletion, we will provide you with a copy of your data before deletion.

5.4 Data Deletion

Upon account closure, your data will be:

• Anonymized for active listings
• Deleted within 30 days for personal information
• Retained for 7 years if required by law (e.g., financial records)

6. Intellectual Property

6.1 Platform Ownership

DeckzMart and all related trademarks, logos, software, and content (excluding user-generated content) are owned by DeckzMart Ltd or our licensors. All rights are reserved.

6.2 User-Generated Content

You represent and warrant that:

• You own or have necessary rights to all content you upload
• Your content does not violate any third-party rights
• Your content does not violate any laws or regulations

6.3 Third-Party Data Attribution

Our market analytics include data from:

• HM Land Registry: Contains HM Land Registry data © Crown copyright and database right 2024
• Office for National Statistics (ONS): Contains ONS data © Crown copyright and database right 2024
• Ordnance Survey: Contains OS data © Crown copyright and database right 2024

You may not extract, download, or redistribute this data outside the DeckzMart platform without proper licensing.

6.4 API Usage Restrictions

If you use our API (when available), you agree to:

• Comply with rate limits and usage guidelines
• Not attempt to reverse engineer the API
• Not use the API for competing services
• Properly attribute DeckzMart in your application

7. Third-Party Services and Partnerships

7.1 Integrated Services

DeckzMart integrates with third-party services, including:

• Alan Boswell Group: Insurance and risk management services
• HomeLet: Tenant referencing and rent guarantee services
• Google OAuth: Authentication services
• Supabase: Database and infrastructure services

Use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability, performance, or data handling.

7.2 Partner Services

When you purchase services from our partners through DeckzMart:

• A separate contract is formed between you and the service provider
• DeckzMart acts as an intermediary only
• Payment processing may be handled by the partner or DeckzMart
• Service delivery and support are the responsibility of the partner

8. Liability Limitations and Disclaimers

8.1 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for:

• Scheduled maintenance downtime (with advance notice)
• Third-party service outages
• Force majeure events (natural disasters, strikes, etc.)
• Cyberattacks or security breaches despite reasonable safeguards

8.2 No Financial or Investment Advice

IMPORTANT: DeckzMart provides market data and analytics for informational purposes only. We are NOT:

• Financial advisors or investment professionals
• Providing personalized financial or investment advice
• Recommending specific property purchases or investments
• Guaranteeing property values, rental yields, or investment returns

Always consult qualified financial advisors before making property investment decisions.

8.3 Market Data Accuracy

While we use reputable data sources (HM Land Registry, ONS), we cannot guarantee:

• 100% data accuracy at all times
• Real-time data availability
• Completeness of historical data
• Absence of errors in data processing or display

8.4 Analytics as Informational Tools

Our analytics, predictions, and AI-powered features are tools to assist decision-making, not guarantees. Market conditions can change rapidly, and historical trends do not guarantee future performance.

8.5 Maximum Liability

To the fullest extent permitted by law, DeckzMart's total liability for any claims arising from your use of the service shall not exceed the total amount you paid to DeckzMart in the 12 months preceding the claim, or £100, whichever is greater.

8.6 Exclusion of Consequential Damages

We are not liable for:

• Lost profits or business opportunities
• Loss of data (beyond reasonable backup restoration)
• Indirect, incidental, or consequential damages
• Damages resulting from third-party actions

9. AI Features and Automated Decision-Making

9.1 AI-Powered Recommendations

DeckzMart uses artificial intelligence and machine learning to provide:

• Property valuation estimates
• Market trend predictions
• Client matching and recommendations
• Workflow automation suggestions
• Pricing optimization guidance

9.2 No Guarantee of AI Outcomes

AI recommendations are probabilistic and based on historical data. They:

• Should be used as decision support tools, not final decisions
• May contain errors or biases inherent in training data
• Require human oversight and judgment
• Cannot account for all market variables or unique circumstances

9.3 Human Oversight Required

You acknowledge that:

• Final decisions are your responsibility
• AI suggestions should be validated by professionals where appropriate
• We are not liable for decisions made based on AI recommendations

9.4 Training Data

Your usage data may be used to improve our AI models, subject to:

• Anonymization of personal information
• Aggregation with other user data
• Compliance with GDPR and UK data protection laws
• Your right to object (contact us to opt out of training data in specific cases at our discretion)

10. Prohibited Uses

You agree NOT to:

• Illegal Activities: Use the platform for any unlawful purpose
• False Information: Submit fraudulent, misleading, or false property listings
• Data Scraping: Extract, harvest, or scrape data using automated tools
• Unauthorized Access: Attempt to access accounts, systems, or data without permission
• Platform Reselling: Resell access to the platform without written authorization
• Reverse Engineering: Decompile, disassemble, or reverse engineer our software
• Harassment: Harass, threaten, or abuse other users
• Spam: Send unsolicited communications through our platform
• System Abuse: Overload or disrupt our servers or networks
• IP Violations: Infringe on intellectual property rights
• Impersonation: Impersonate other users, businesses, or DeckzMart staff

11. Account Termination

11.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support. Subscription charges will continue until the end of the current billing period.

11.2 Termination by DeckzMart

We reserve the right to suspend or terminate accounts for:

• Violation of these Terms
• Fraudulent activity or payment disputes
• Abusive behavior toward staff or other users
• Legal requirements or court orders
• Extended account inactivity (with prior notice)

11.3 Data After Termination

After account termination:

• You may request a data export within 30 days
• Personal data will be deleted or anonymized after 30 days
• Some data may be retained for legal compliance (up to 7 years)
• Public property listings may remain anonymized in archives

11.4 Outstanding Payments

Termination does not waive your obligation to pay any outstanding fees or charges incurred before termination.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any disputes.

12.2 Dispute Resolution Process

Before initiating legal proceedings, we encourage you to:

2. Informal Resolution: We will attempt to resolve the matter within 30 days
3. Escalation: If unresolved, you may escalate to formal mediation

12.3 Alternative Dispute Resolution (ADR)

If informal resolution fails, we agree to participate in mediation through a mutually agreed ADR provider before pursuing litigation. Mediation costs will be shared equally.

12.4 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law, including rights under the Consumer Rights Act 2015.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be:

• Posted on this page with a new "Last Updated" date
• Notified to registered users via email for material changes
• Effective 30 days after notification for material changes
• Effective immediately for non-material changes

Continued use of the service after changes take effect constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the platform, constitute the entire agreement between you and DeckzMart Ltd.
